Easdale Island Harbour

The community of Easdale Island is built around its harbour, whose “B” listed walls were constructed in the eighteenth century around a naturally existing bay.

The harbour is a unique example of the architectural and industrial heritage of the area and has played a central role throughout the island’s colourful history. It is also a key feature of island life in terms of practical necessity, allowing safe operation and mooring of the ferry and various utility boats which make life on the island practicable.

Its viability is crucial to the retention of local jobs in the fishing industry and it is also of recreational importance enjoyed by locals, holiday home owners and by visitors. For many people, use of the harbour is an important factor which has led to residence or property ownership on the island.

Unfortunately, the harbour has suffered from years of neglect and substantial funding is required to meaningfully restore it.

The Eilean Eisdeal Trust has recently secured a fifty-year lease of the harbour area from the island’s owner as a first step towards realising this goal, which is fundamental to the very sustainability of the community of Easdale Island.

Plans to secure funding for the harbour restoration scheme are currently being pursued. It is a complex project and progress is envisaged to occur in the form of sequential phases, each one being a step towards the overall goal. The first of these, following consultation with harbour users and our Marine Consultant, is to implement a series of small scale improvements. These aim to ease the short term problems of harbour use for islanders, halt further decline in the fabric of these historic harbour walls and will include investigative work upon which further plans can be assessed, dredging in key areas and provision of pontoons to accommodate small utility craft and dinghies.

Eilean Eisdeal Trust
Harbour Rules and Regulations

For the purpose of these Rules and Regulations “Master” Shall include owners, charterers, licensees, any authorised agent of the “Master” or other person for the time being lawfully in charge (other than the Trust) of the vessel/vessels.


1. GENERAL

1.1. Easdale Harbour comprises the area as delineated in and by the lease between Mr. Clive Feigenbaum and Eilean Eisdeal Trust. (a copy is available for inspection from The Eilean Eisdeal Trust).

1.2. The Eilean Eisdeal Trust shall exercise the powers of general supervision of the Harbour.


1.3. Masters will be responsible for the conduct of and fully accountable for
any loss, injury or damage, or nuisance caused or committed by their crew
members, agents or guests while on board the vessel or on duty within the harbour.

1.4. (a) All vessels and vehicles in or on the Trust’s Harbour or premises may
be moved by the Trust to any other part of the Harbour or premises.

(b)The Trust shall not be liable for any loss theft or damage of whatsoever nature caused to any vessel or vehicle or other property of the owner or others claiming through the owner except to the extent that such loss, theft or damage may be caused by the negligence or wilful act of the Trust or their servants for whom the Trust are responsible.

(c) The Master shall indemnify the Trust against all loss damage,costs, claims or proceedings incurred by, or instituted against the Trust or their servants or agents which may be caused by the Masters vessel or vehicle or by the Master, his servants, agents, crew, guests, or sub-contractors except to the extent that such loss, damage, claims or proceedings may be caused by the negligence or wilful act of the Trust or those for whom they are responsible.

(d) The Master shall insure his vessels and vehicles adequately against loss or damage howsoever caused and shall maintain third party insurance in respect of himself and each of his vessels or vehicles, his crew for the time being and his agents, visitors, guests and sub-contractors. Such insurance shall be effected and maintained in an insurance office of repute and the Master shall produce the policy or policies relating thereto to the Trust on demand.

1.5 Except with the written consent of the Trust, no commercial venture shall be carried out on Trust premises, and no vessel shall be used by the Master or his agents for any commercial purposes. The occasional use of the vessel by a personal friend of the Master on payment to the Master of a contribution towards the actual running cost of the said vessel shall not be deemed a commercial pupose hereunder.

1.6 Masters are permitted to carry out normal maintenance work on their vessels in the harbour. Work on vessels by outside contractors may be carried out with the prior permission of the Trust.

1.7 The vessel shall be berthed or moored by the Master in such a manner and position as the Trust may require and the necessary warps and fenders shall be provided by the Master. Berths may be rented calculated by reference to the Trust`s published charges.

1.8 All persons are required to park their vehicles/trailers/cradles etc. in such a position and manner as from time to time shall be directed by the Trust.

1.9 Fishing within the harbour mouth is not permitted.

1.10 Vessels must not be used for permanent residential purposes.

1.11 All vessels are to be maintained in a seaworthy condition.

1.12 The Trust have the right to exercise a general lien upon any vessel and/or her gear and equipment whilst in or upon their premises or afloat at any of their berths until such time as any money due the Trust in respect of the vessel and/or her gear whether on account of rental,storage or berthing charges, landing dues, work done or otherwise shall be paid.

1.13 (a) The Trust shall have the right (without prejudice to any other rights in respect of breaches of these Rules and Regulations by the Master) to terminate the lease or permissions granted to the Master in the event of any breach by the Master of these Rules and Regulations, or the conditions of the lease or permission, in the following manner. If the breach is capable of remedy the Trust may serve notice on the Master specifying the breach and requiring him to remedy it within 14 days. If the Master fails to remedy such breach within 14 days, or the breach is not capable of remedy, the Trust may serve notice on the Master specifying the breach (when not already specified) and requiring him to remove the vessel within 28 days, at the expiration of which the Master shall remove the vessel from the Harbour. The Trust shall refund to the Master the unexpired portion of any rent subject to a right of set-off in respect of any damage suffered by the Trust as a result of a breach by the Master of these Rules and Regulations or the conditions of the lease or permission.

(b) If the Master fails to remove the vessel on termination of the lease or permission (whether under this Clause or otherwise) the Trust shall have the right to remove the vessel from the Harbour and thereupon may secure it elsewhere and charge the Master with all costs arising out of such removal including alternative berthing fees.

1.14 The Rules and Regulations must be observed by all persons using or visiting the Harbour and may be altered or amended from time to time by the Trust. Upon such notice of amendment being displayed and served on the Master it shall be deemed to be incorporated in the lease or permission granted to the Master at the expiration of 14 days from the date of the notice.


2. SAFETY

2.1 All persons visiting or using any part of the Eilean Eisdeal Trust’s Harbour, or premises or facilities within the Harbour for whatever purpose, do so at their own risk unless any injury or damage to person or property sustained within the Harbour was caused by or resulted from the Trust’s negligence or deliberate act or that of those for whom the Trust is responsible.

2.2 Swimming and skin diving are not permitted within the Harbour unless authorised for a specific purpose by the Trust.

2.3 All vessels must be equipped with adequate fire fighting equipment as recommended by the Royal Yachting Association and the Department of Trade and Industry in the RYA publication G9, or as required by law.

2.4 Petrol and other inflammable substances shall not be stored on a vessel except in a receptacle specifically constructed for such purposes.

2.5 Smoking and naked lights are strictly forbidden in the refuelling area. Engines must be switched off when refuelling.

2.6 A speed limit of three knots applies to all vessels under power within the Harbour and no vessel shall be navigated at such a speed or in such a manner as to endanger or inconvenience other vessels in the Harbour.

2.7 The Trust shall have the right to moor, re-berth, board, enter or carry out any emergency work on a vessel if in the Trust’s opinion such be necessary for the safety of the vessel or the safety and/or convenience of other users of the Harbour, or for the safety of the Trust’s premises, plant and equipment and the Master shall pay the Trust charges for such work.


3. POLLUTION

3.1 No refuse shall be left on the quaysides, pontoons, jetties or slipways or disposed of in any way other than in the receptacles provided by the Trust or by Argyll & Bute Council.

3.2 Refuse, galley waste, effluent and sewage must not be discharged into the Harbour. Toilets not connected to a sewage holding tank must not be used.

3.3 Oil, fuel or foul bilge water must not be discharged into the Harbour.


4. HEALTH AND RABIES PRECAUTIONS

4.1 Masters must abide by and conform with all Health Regulations.

4.2 In view of the proximity of rabies on the Continent of Europe the Trust may at any time and without prior notice require that all dogs and other animals are removed from the Harbour. No animal taken abroad may be brought into the Harbour.


5. NUISANCE

5.1 Masters are requested not to bring dogs or other animal pets on to the Trust’s premises. In the event of the Master finding it necessary to do so he shall ensure that the animal is kept under strict control within the confines of the Harbour. Dogs under the control of the Masters and visitors to the Harbour must be kept on a leash when not on board a vessel. Any fouling by animals of the quaysides, pontoons, jetties, slipways, paths or approaches shall be cleared up immediately by the Master.

5.2 All persons are required to behave in such a way as not to cause offence to others.

5.3 Noisy, noxious or objectionable engines, radios or other apparatus or machinery shall not be operated within the Harbour so as to cause any nuisance or annoyance to the Trust, to any other users of the Harbour or to any person residing in the vicinity. Every effort must be made to minimise noise from halliards and rigging.


6. OBSTRUCTION

6.1 Tenders may not be left in the water or on the quaysides, jetties, slipways or pontoons when not in use but must be stowed aboard the parent vessel unless a berth is separately provided or an area for the parking of tenders is designated by the Trust.

6.2 No items of boats, gear, fittings or equipment, supplies, stores or the like shall be left upon the quaysides, walkways, jetties, slipways or pontoons without the written permission of the Trust.

6.3 Vessels must be moored in such a way as not to overhang or obstruct other berths, moorings, jetties or pontoons.

6.4 Masters are not permitted to lay anchors or moorings within the Harbour without the written permission of the Trust.


7. SECURITY

7.1 The Trust requests berthholders to assist in the maintenance of adequate security within the Harbour by securely locking their vessels when not in use and storing below, where possible, valuable equipment
